Acceptance of Terms

By accessing or using BlinkPic Studio ("the Service"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Changes become effective upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

Eligibility

You must be at least 13 years old to use BlinkPic Studio. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements and have the authority to enter into these Terms.

Account Responsibilities

When you create an account, you are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Ensuring your account information is accurate and up to date
• Notifying us immediately of any unauthorized access or security breach

You may not share your account with others, create multiple accounts to circumvent plan limitations, or use another person's account without permission.

Acceptable Use

You agree to use BlinkPic Studio only for lawful purposes. You may not:

• Generate or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Create content that infringes intellectual property rights, privacy rights, or other rights of third parties
• Use the Service to impersonate others or misrepresent your affiliation with any person or entity
• Attempt to reverse engineer, decompile, or extract the underlying technology
• Use automated scripts, bots, or tools to access the Service beyond normal usage
• Interfere with or disrupt the Service, servers, or networks
• Violate any applicable laws, regulations, or these Terms

We reserve the right to suspend or terminate accounts that violate these usage restrictions, with or without notice.

Billing, Credits, and Subscriptions

Subscription Plans

BlinkPic Studio offers various subscription plans with different credit allocations and features. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis according to your selected billing cycle (monthly or annual).

Credits

• Image generations cost 1 credit each
• Image edits cost 5 credits each
• Credits are allocated monthly based on your subscription plan
• Unused credits do not roll over to the next billing period
• Credits are non-transferable and have no cash value

Billing and Renewals

Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current rate for your plan. We will notify you of any price changes at least 30 days in advance.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of your current billing period. You will retain access to your plan features until that time. Cancellation does not entitle you to a refund for the current billing period.

No Refunds

All payments are final and non-refundable. We do not provide refunds or credits for partial months of service, unused credits, or any other circumstances. This no-refund policy applies to all subscription plans and one-time purchases.

Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated charges. Downgrades take effect at the start of your next billing cycle.

Content Ownership and Rights

Your Content

You retain ownership of all content you upload to BlinkPic Studio (such as images and prompts). By uploading content, you grant us a limited license to process, store, and display your content solely for the purpose of providing the Service to you.

Generated Content

Subject to your compliance with these Terms and applicable law:

• You own the images generated by the Service based on your prompts and inputs
• You are responsible for ensuring your use of generated content complies with all applicable laws and does not infringe third-party rights
• We make no representations or warranties regarding the originality, uniqueness, or legal compliance of generated content
• You agree to indemnify us against any claims arising from your use of generated content

Our Rights

BlinkPic Studio and all related trademarks, logos, and intellectual property are owned by us or our licensors. You may not use our trademarks or branding without prior written permission.

Service Availability and Modifications

We strive to provide reliable service but do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may:

• Modify, suspend, or discontinue any part of the Service at any time
• Impose limits on certain features or restrict access to parts of the Service
• Perform scheduled or emergency maintenance that may temporarily interrupt service

We will make reasonable efforts to notify users of significant changes or planned maintenance.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or quality of the Service
• Warranties that the Service will meet your requirements or be uninterrupted or error-free

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLINKPIC STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless BlinkPic Studio and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your content or generated content

Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for:

• Violation of these Terms
• Suspected fraud or abuse
• Failure to pay fees when due
• Extended period of inactivity

Upon termination, your right to use the Service immediately ceases. We may delete your account data, though some information may be retained as required by law or for legitimate business purposes.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which BlinkPic Studio operates, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations.

General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and BlinkPic Studio
• Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in effect
• No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision
• Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction
